These Terms and Conditions relate to all facilities owned and activities operated by Active Tribe Ltd. (Active Tribe) at Courtown Harbour, Gorey, County Wexford
Upon making a booking, becoming a member or entering Active Tribe, a customer accepts and agrees to be bound by these terms and conditions. A customer also agrees to have read and understand the risks associated with using the facilities or undertaking activities and agrees to our legal waiver. We expect all customers and staff to adhere to our Codes of Conduct. Our Safeguarding Statement is available here.
January 2024 Membership Promotion
if you are a current member or take out a new membership by 31 January 2024 your membership price will remain at 2023 prices for all of 2024 as long as you continue to be a paid up member. Any memberships that are cancelled by a member or by us due to delayed payment will need to be restarted at the new 2024 pricing.
We are also offering members the ability to freeze your memberships for a minimum of 1 month and up to 2 months per year for €20 per freeze. This will help members maintain their memberships through the year at 2023 pricing. For example, a member on an annual contract could freeze their membership over the summer months if they are planning on being away. To activate your membership freeze, just pop into Reception and they will arrange it for you.
Minimum Age Policy
Access to the gym including free weights is for those aged 18 years and over. Children aged 16 years and over can access the cardio machines in the gym only
Access to group fitness classes is for those aged over 16 years. Under 8s must be accompanied by an adult (over 18) at all times. Children aged 8 to 11 years old must be supervised by an adult. The facility is only open to adults after 8:00pm
Refund Policy
A refund, reschedule or credit for non-use of membership, booked activity/facility or class (including swimming class) will not be granted under any circumstances. In circumstances where a customer has been advised to cease fitness activity or isolate by a medical professional we can review a request for refund if it is accompanied by a medical note or evidence of instruction to self-isolate. Any request for a medical refund can be made to the manager via email to hello@activetribe.ie
Booking Cancellation Policy
Guests can cancel online bookings by logging in using the email address they used in their bookings: www.activetribe.ie/member. They may need to reset their password prior to logging in: www.activetribe.ie/reset. The unused products resulting from the cancelled bookings can then be used by the customer in a future booking by logging back into www.activetribe.ie/member. No refund is offered for cancelled bookings or unused products
Returns Policy
Any product bought at Active Tribe that is faulty should be returned to the centre with a valid receipt as proof of purchase. Swimwear and related accessories cannot be returned for hygiene reasons so please ensure you select the correct size clothing or accessory prior to purchase.
Purchases for bookings, courses, lessons, classes etc. are non-refundable, nor is a refund available in cases where a customer ‘changes their mind’ regarding the purchase of a product or service. In all aspects regarding refunds, centre management’s decision is final
Infectious Medical Condition
Customers agree not to visit Active Tribe if suffering from an infectious or contagious medical condition or has symptoms of such conditions. We reserve the right in our discretion to refuse entry to a customer who appears to have an infectious or contagious medical condition
General Fitness Screening
If you answer yes to any of the following we strongly advise you to book a fitness assessment prior to training at Active Tribe Courtown:
- history or family history of heart disease
- high blood pressure or medicated for the same
- smoking habit
- diabetes/Mellitus
- high cholesterol
- asthma/respiratory disease
- recent surgery
- chronic disease
- pregnancy within the last 3 months
- back, joint or muscle disorder
- incidents of seizure, blackout or fainting
- taking any medication or substance
- more than 20lbs overweight
- exercise has been recommended to you by a medical professional
Customers are required to accept responsibility for their personal, medical and physical condition in order to take part in Active Tribe activities including the use of the gym and gym equipment, swimming, sauna and steam rooms. Any assessment undertaken in the facility is for general information only with a view to giving advice and should not be relied on by customers as certifying their fitness or otherwise to the facilities or equipment.
Active Tribe advises all customers to consult with their doctor or medical professional prior to beginning a programme of physical exercise
Fitness Classes
All group fitness classes listed in the group fitness timetables can be viewed under the member’s portal. “Swim, Gym and Classes” membership includes the cost of all fitness classes and will allow you to book classes in advance. The cost of swimming lessons, outdoor camps and courses are not included in any membership and must be booked and paid for separately and in advance within the appropriate member portal. Classes are available for persons aged over 16 years only unless otherwise stated. 24 hours’ notice is required to cancel a class booking. Active Tribe reserves the right to withdraw booking privileges if you fail to give the required notice to cancel a class. Classes are subject to change at any stage.
Swimming Pool Use
All swim slots should be booked in advance of arriving on site. Swim slots can be booked and paid for on a pay as you go basis at Reception, from our website and booked free of charge by members through the membership portal. A 'swim' booking offers you use of part of the main pool
For operational reasons, some other facilities may not be available for you to use as part of your booking (such as water slide, learner pool, toddler pool, part(s) of the main pool, sauna, Jacuzzi/Spa Pool, steam room, parts of the changing room or shower facilities). No refund or credit will be offered should any such facility not be available for your use
Pool Use Rules
- Swim hats must be worn in the pool at all times by pool users aged 3 years or older. They can be purchased at Reception
- All children who are not toilet trained must wear a swim nappy when they are in the pool. Disposable nappies can be purchased at Reception
- All children under 8 must be accompanied by an adult at all times. This includes when the children are not in the learner pool
- Please shower before entering the pools and after using the Health Spa
- Appropriate swim wear must be worn at all times
- Running, jumping and acrobatics are strictly prohibited in the pool area
- The lifeguard’s instructions must be followed at all times
- Snorkels, flippers and glass masks are not permitted without permission from the lifeguard on duty
- Outdoor footwear is not permitted on the pool deck
- Swimmers are encouraged to wear pool flip flops/jandals/sandals on the pool deck
- Food or drink is not permitted in any of the activity, pool or changing areas of the facility. Chewing gum and glass containers are strictly prohibited anywhere on the site
- Lockers are provided in the Changing Village and require a refundable €1 coin to operate
- Active Tribe Courtown is not responsible for the loss of personal belongings. Please use lockers provided
- Balls and other inflatables and toys are permitted in the pool but if they cause discomfort for other users they must be removed
- When swimming in the lanes please follow correct lane etiquette
- Those under 18 years old are not permitted in the Health Spa
- A minimum of height restriction of 1.2m applies when using the Flume Water Slide
- All swim sessions start on the hour or half past the hour
- The pool timetable is subject to change at any time as directed by centre management
- The last swim will finish 15 minutes before the end of the last time slot of the day
- The building will close half an hour after the final whistle has blown
- Access to storage rooms is strictly prohibited
- Management reserves the right at any time to vary these rules and the centre timetable
Sauna, Steam Room Health Spa Rules
- The Health Spa is an adult only area. Those under the age of 18 are not permitted in the Health Spa. Please read the user guidelines for each facility before use
- For health and safety reasons it is advised guests with known medical issues such as, but not limited to, heart conditions, high/low blood pressure, diabetes, respiratory conditions or are pregnant seek the advice of a medical professional before using the Health Spa facilities
- Observe a sensible time limit of 5-15 minutes in the Health Spa
- The Spa Pool is controlled by an automatic timer and should be vacated when the bubble period ends
- Shower between each heat exposure and before returning to the pool(s)
- Appropriate swim wear must be worn at all times
- It is recommended to remove all jewellery before using the Health Spa facilities
- A heat/cold cycle can be repeated as often as comfortable. However, extended use of the Health Spa facilities way result in nausea, dizziness or fainting. If you feel any of these symptoms please alert a member of staff immediately
- Shaving and the use of creams, oils and lotions is not permitted in the Health Spa
- The use of shampoo and shower gels is not permitted in the Health Spa
- Food or drink is not permitted in any of the activity, pool or changing areas of the facility. Chewing gum and glass containers are strictly prohibited anywhere on the site
- The use of mobile phones, cameras or any other recording equipment is strictly prohibited throughout the centre
- The Sauna, Steam Room and Health Spa are not available during Children's Swim Academy
Gym Rules
- For health and safety reasons it is advised guests with known medical issues such as, but not limited to, heart conditions, high/low blood pressure, diabetes, respiratory conditions or are pregnant seek the advice of a medical professional before using the Gym
- Please use the lockers provided in the Changing Village and require a refundable €1 coin to operate
- Chewing gum and glass containers are strictly prohibited anywhere on the site
- Children under the age of 16 are not permitted to use the Gym
- Children aged 16 and 17 are not permitted to use the free weights and resistance machines
- Bring and towel to the Gym and clean/wipe down your equipment after use
- Food is not permitted in the Gym. Chewing gum and glass containers are strictly prohibited anywhere on the site
- Please return/tidy your equipment after use and report any defects to a member of staff
- Appropriate clothing, including footwear, must be worn at all times
- The instructions of centre staff must be followed at all times
- The use of mobile phones, cameras or any other recording equipment is strictly prohibited throughout the centre
- Always use CV and weight machines as directed. If you have any questions regarding exercises, programmes or machinery please contact a member of staff
Dance/Fitness Studio Rules
- Use of, and access to, the Dance Studio is not permitted without an accompanying member of staff
- Food or drink is not permitted in any of the activity, pool or changing areas of the facility. Chewing gum and glass containers are strictly prohibited anywhere on the site
- The use of mobile phones, cameras or any other recording equipment is strictly prohibited throughout the centre.
- For health and safety reasons it is advised guests with known medical issues such as, but not limited to, heart conditions, high/low blood pressure, diabetes, respiratory conditions or are pregnant seek the advice of a medical professional before using the Dance/Fitness Studio
- Children under the age of 16 are not permitted to take part in Fitness Classes
- No lockers are available in the Dance/Fitness Studio. Please use the lockers provided in the Changing Village and require a refundable €1 coin to operate
- Food is not permitted in the Dance/Fitness Studio. Chewing gum and glass containers are strictly prohibited anywhere on the site
- A booking must be made online or at Reception to attend fitness classes/courses
- The directions of staff must be followed at all times
- Please do not turn on/off, adjust or block the air conditioning equipment
- Please clean/wipe down your equipment after use
Food and Drink
Food or drink is not permitted in any of the activity, pool or changing areas of the facility. Chewing gum and glass containers are strictly prohibited anywhere on the site.
The consumption of alcohol or any other intoxicating substances on site at any time is strictly forbidden. The discovery of such items will result in them being destroyed and/or Gardai being informed
Mobile Phones, Cameras and Recording Equipment
The use of mobile phones is strictly prohibited in the Changing Village, pool side, gym, Dance Studio and outdoor activity areas of the facility. Cameras and recording equipment are strictly prohibited in all areas of the facility. Please respect other customers’ right to privacy and to use the facilities without being recorded or photographed
Lockers
Lockers must be used by all customers to secure belongings. The customer acknowledges that the facility will not be responsible for the loss of any personal items or damage to personal property, either in the facility or in the facility car parking areas
Personal Liability
The customer acknowledges that the facility accepts no liability whatsoever for any personal injury or damage sustained by the customer while they are on site, using the facility, partaking of activities or in the parking areas
Repairs
The facility management will use its best endeavours to ensure that all facilities, apparatus and equipment are maintained in working order but accepts no responsibility to the customer for failure, breakdown of or inability to use any equipment or apparatus howsoever caused
Membership Conditions
Memberships are designed to give you, the customer, the opportunity to pay for use of Active Tribe facilities by use of a recurring or upfront payment. There are a number of categories of memberships which give you benefits as follows:
- Adult Membership
Various recurring monthly and annual membership packages are available on www.activetribe.ie
- Child Membership
To qualify for child membership you must be aged between 3 and 17. Child memberships are only available when linked to an adult membership. Children are restricted from certain activities and areas as outlined in these Terms and Conditions. All children under 8 must be accompanied by an adult in the water unless the child is participating in a swimming lesson.
Freezing Your Membership
You have the option to freeze your membership at Reception for a minimum of 1 month and up to 2 months per year for €20 per freeze. Periods of non-use of the facilities cannot be backdated under any circumstances.
Recurring Payments
Payments on the monthly recurring payment option are due regardless of usage. This contract automatically renews on a month-to-month basis after the minimum period. You will not be eligible to use the facility if your account is in debt. We reserve the right to cancel your membership if payment has not been received within 14 days of the due date. Customers with cancelled membership accounts will not be eligible for a refund or to retain any paid joining fees. Some of our membership packages may have joining fees. New members or previous members with cancelled accounts may be required to pay a joining fee (where applicable to the membership package) when signing up for a membership account.
Termination of Membership
Management reserves the right to terminate any membership for violation of any rules or regulations of the club or for conduct deemed by the management to be detrimental to the welfare, good order or character of the facility or its members and users without refund.
Membership Cancellation Policy
Members are able to cancel their membership outside of any minimum membership duration period on their online membership portal. Under the exclusion of contracts for Leisure Activities in the Consumer Rights Act 2022, Part 5, Chapter 5, Section 111, Consumers do not have the right to refund from cancellation of their contract. No full or partial refund will be given for unused periods of membership or joining fee (where paid). A minimum of 4 hours’ notice to cancel a fitness class booking is required. Class booking can be self-managed through the online membership portal.
Transfer of Membership
Membership may not be transferred or assigned to another person. Membership deposits and fees are not refundable under any circumstances.
Health Screening
The member acknowledges that they are in good health and is not suffering from any illness or disease. The facility health screening status questionnaire must be completed and signed by all members in advance of using the facility
Membership Card
Your membership card permits you to enter to the facility to the areas assigned to your membership type. Under no circumstance may you permit any other person to use your card to gain entrance to the facility. Abuse of membership cards will result in membership termination without refund. Lost cards are replaced at a cost of €5 per card.
Disputes
In the event of any dispute arising between a customer of the facility and the management of the facility, the decision of the management will be final. The management reserve the right, in its absolute discretion, to refuse entry and remove from Active Tribe without refund any person:
- Not complying with these terms and conditions
- Deemed to be behaving in a manner which, in the opinion of any Active Tribe employee has affected or is likely to affect the safety or enjoyment of, or cause annoyance, danger or distress to other customers or damage to property
- Who uses threatening, intimidating, abusive or insulting words or behaviour or in any way provokes
or behaves in a manner which may provoke a breach of the peace - Appears, in the opinion of an Active Tribe employee, to be under the influence of alcohol or other substances
- Fails to comply with the instructions of staff
- Damages property
- Who, for any other reason, at the sole discretion of Active Tribe employees, is deemed to be necessary of removal from the site
- Any customers or staff that do not adhere to our Codes of Conduct
Amendments
The management reserves the right to amend and add to these conditions or rules as it sees fit and the customer shall observe any amended or additional conditions or rules so made
Jurisdiction
These Terms & Conditions, all disputes and issues between the Operating Company and you arising out of or in any way relating to these Terms & Conditions shall be governed by and construed in accordance with the laws of Ireland
